  • Directions Hearing for Non Molestation and Occupation Order Appeal.

    To cut a long story short my Husband had a Non Molestaton and Occupation Order placed against me last December built on untruths.I was found Not Gulty of a Criminal Case(Assult by Beating of him)in January.I have appealed against the orders and it is due for a directions hearing in May.I have served the court exhibits of my Husband harassing me and evidence of abusive messages/emails he has sent to me since since the orders have been in place.
    His Mother has now been in touch with me saying he is willing to apply for the orders to be dropped but I have to drop my appeal as he doesn't want to "spend anymore time in court".Surely he can do this on the day of the appeal?Shall I proceed with what I am doing or what he is asking for?I just want to get this out the way as stress free as possible and not have him me controlling me any more and move on with my life.

    It's not for me, or anyone else, to advise you on the personal aspects of this, but as it seems clear that your husband wants nothing to do with you, it might be wise to formalise that by applying for divorce or separation, rather than spending time and money, appealing a non molestation Order obtained against you by your husband.

    Be that as it may, I suggest you post up what the Order said & what the date of it's expiry is and the grounds of your proposed appeal.

    You might also wish to consider whether it would be useful for you to obtain a non-molestation Order against your husband.
