  • Court and legal aid

    Hi all,
I'm new to this. I have a step Daughter and two other children with my husband. My Step Daughter loves with us and has done for the past 6 years. She sees her mum every other weekend.

anyway, my husband and I applied to court recently due to my step daughter's mothers drunken and violent behaviour which caused my SD to become scared. Court ruled in our favour and put in place that over night contact would to be stopped until the next court hearing etc.

So my step Daughters mother the respondent has applied for legal aid and we aren't sure how she has been able to get legal aid as we were under the impression it all stopped? Her solicitors are awful and very unprofessional people with bullying behaviour. Can we ask her solicitor for a legal aid certificate?

Hi Babyjo5, legal aid has not entirely stopped. it is only available in cases where there is evidence of domestic violence for example, non molestation order granted to her by the courts, police investigations ongoing regarding domestic violence, she has been in refuge before, child/ren are on the child protection register or there has been a reported domestic abuse to a recognised authority such as GP, domestic abuse officers etc. The solicitors will have to provide you with a copy of the certificate if the child's mother is granted one. Hope this helps
