  • Recent Separation

    Hi everyone,

hopefully someone one can help me with some basic info in the interim if me finding some local legal help.

my partner and I have separated, actually several times in a matter or weeks. Realising we're going round in circles and getting nowhere I've ended it. This was an extremely difficult decision as we have a baby together.

We jointly have a mortgage on the house we live in. I've agreed she can continue in the house at this point and I'll pay half the mortgage for her benefit and the benefit of my credit file as obviously I have an obligation to the mortgage agreement.

She insists she is getting a solicitor because she doesn't want to sell the house and have to move. She can't afford he mortgage as a sole borrower nor can I afford to continue paying circa £1k/month as infinitum. Where do I stand on this? Surely despite having a child together I cannot be forced to pay half my income to a house I'm getting no benefit of whilst not being able to afford to then get a house of my own? I'm in no particular rush to sell it but paying half while she refuses to put the house in the market forever is not a long term good thing for me or my bank account.

Its my understanding that we both jointly own it, so neither can make the other move put or prevent them access to the property. So surely (I would hope) I cannot be left in an open ended situation paying all this money.

    many thanks in advance
    Dave
