I'm not sure if any of you can help but l thought l would ask as I cannot afford the solicitor fees that have been quoted for my case and my duty solicitor is really poor in my opinion.
I have been with my new partner for a couple of months now, she is from Lithuania and has 2 children. The first child was born there and the 2nd was born in UK both with her husband who has now returned to Lithuania.
He has now started a case of my partner abducting his 1st child and wants the child to return home to his country. Now he is using a Lithuanian court to get this done so she is having to travel back to go to court which l didn't think they had rights to make her do that.
The main case is he says they wasn't supposed to stay here for ever and was only a temporary situation and then plan was to return home! This wasn't the plan he became alcoholic and abusive so the relationship ended and he returned home but she stayed, her mom then moved here to help with children so she could work and has worked and supported all the family with no help from him or anyone. He has used certain excuses that she was then drinking being a bad parent as you can imagine, now saying he is depresssd because they have split up and anything he can.
So what I would like to know is can the Lithuanian court even decide this and is it possible in anyway they would split the family up and send the 1st child home ??
We are worried but I have no idea about these things and the rules of the law....can anyone shed any light or advice on this please
