Hi,

Sorry to burden you again but i have one more question before i make a decision what to do.

I currently have a contact order and PR to see my daughter once a fortnight in a contact centre. Due to myself and the mother not getting on at all, and this time it is mainly down to myself she is refusing to bring my daughter to the centre, i am not wanting to enforce the order as the judge may say i brought it on myself. So if i already have a contact order in place am i allowed to apply for another contact order and start from fresh at the very beginning and get a hearing??

Are you not going through mediation?

She does not have to bring your daughter to the contact centre since a friend/relative of hers could do so if she did not want to see you. The old "i don't want to see him" routine is an excuse and HAS to be enforced if mediation is not working. Stop caring what the judge says.

She does not have to bring the child to a contact centre, a friend/relative can. Enforce the order since she has not sought legally to stop the order or vary it. Don't waste the court's time on a new agreement but enforce the current one.

I am going to mediation next week in order to file a new contact order as the judge wont look at the case without it. She has refused mediation in the past and will continue to do so.

I have been awful to her friends and family to, and they are very hesitant to bring her, thats why i am very apprehensive about going for an enforcement as the judge may rubbish it and i will have to start the case again from scratch. Also the reasons she has stopped contact was due to a message that was sent to somebody who is not part of this situation and it was deemed dangerous, even though it was nothing to do with my daughter at all

Can you see why i am confused as i have brought alot of this on myself.

Nope I can't. You attended contact regularly and you do not have to be best buddies with HER friends. They;re not your friends and if they are trying to talk bad about you why should you be polite EXCEPT if your child is present.

Experience of an enforcement order

Hi,

Does anybody know or have had experience of enforcing an order of contact to see your child, if so can you please share it with me and tell me what it ensues.

Enforcement order completed and filed!!

After much deliberation and humming and harring i have finally filed my enforcement order. It was a choice between starting from scratch with a c100 or enforcing the order i already have in place. I had to wait for multiple breaches, there have been 3 this year and in the form i have also mentioned the 5 breaches from last yr .
As most of you know i was torn as i wasnt sure weather the judge would have said i brought contact to an end due to my actions which in turn would have meant my enforcing the order would not have worked. But with advice from here and other pages im going in for the kill...ill keep you all updated and hopefully share my knowledge for anybody who wants to do it in the future

Hi,

As you know i filed an enforcement order 3 weeks ago and it is currently with the district judge.

If the judge decides to not enforce the order and in the worst case scenario says i brought it up on myself what do i do then??.. People have said i will have to start from scratch with a C100 and apply for contact all over again, but what then happens to the order i already have in place?? does the existing order ive had for 18 months become invalid if my enforcement hearing fails and the respondent keeps choosing to not bring my daughter to the centre??
