  • Enforcing a Court Order

    Hi,

    I'm looking for some advice on what to do with the following situation (and costs):

    Just over 12 months ago, a contact order was finally granted to enable me to see my daughter on every alternate Wednesday and every alternate Sunday. Fine. Until now.

    The Wednesday part was dropped with agreement from me and the mother because of time constraints and my changing work hours, but the alternate Sundays were kept.

    2 weeks ago, I should have seen my daughter, and I was told by the mother that she didn't want to come and was hiding under the quilt etc. (even though literally 2 minutes before I dropper her off the last Sunday I had her she had said she wants to see me every day!). I thought about it, and left it to see what happened this week (i.e. today - Fathers Day!). Again I have been told she doesn't want to come but that I could speak to her (A little contradictory in my opinion), and I've text to say 'let me speak to her' to which I can see the message has been read and had no reply. That was 8:30ish this morning.

    I suppose my question is what do I do now? Can I go to court and apply for an enforcement order to be given? There is no valid reason I am being prevented from seeing my daughter and the mother is saying leave it for a few weeks to a month - no chance - I had a long period without seeing my daughter properly last time and had to fight it out though court.
    There is no reason she isn't coming - there are no police reports, CAFCASS would have nothing to report back on, and neither would Social Services.
    How quickly do enforcement cases happen, and what is the cost?
    I have to represent myself in any case because I was declared bankrupt 2 years ago and haven't the disposable income to pay solicitors fees.

    Any advice will be greatly appreciated.
