  • What rights do I have to my Brother.

    Hi all, I'm Dr F, I'm new to this forum and I am coming here for some advice regarding my rights towards my brother.

    Let me explain the situation first;

    I have gotten into a relationship which my parents do not accept. As I have now moved in with my girlfriend they will not visit me, I have a brother who is 8 and I am 21. Basically they let me see my brother in their house but whenever I want to take my brother to lets say a theme park or take him over to my house for a sleep-over, they come out with excuses and will not let me take him.

    So my question is what are my rights, can I request to take my brother out of their house under any rights?

    I do not have bad influence on my brother, but over the last years I haven't really have had a chance to spend more time with my brother, unfortunately I have been busy working and studying at the same time, believe me doing a night shift and at the same studying will force you to have no social life what so ever.

    If you need more details to answer my questions, please just ask.

    Unfortunately no you do not have any rights as they have parental rights therefore it is their decision am afraid.

    All you can try and do is point out that by not letting you and your brother have a proper brotherly relationship it is detrimental to him more than it is to you. And is very likely to effect him as he grows up. Its him they are punishing not you basically!

      I have nothing to add concerning your right to spend time with your brother but I just wanted to make a small comment. I do not know you, your girlfriend or your parents but if you were my son I would be so proud of you. I had to study, work full time and keep a roof over my head at the same time and I know how hard it is. The fact that you still can carve out the time and expense of taking your little brother out for treats is astonishing and I take my hat off to you.:yo:

        DrF, the only way that you can do what you want is to request an order from a family court for access. However, the family are not barring you access from your brother, they are merely drawing a line into what they are currently happy for you to do ie supervised access in the family home.
        The older the child gets then the easier these kinds of trips will be. Have you suggested to the parents about a day out to a theme park? That might be a way of doing this.
