  • Court Order not being adhered to. Advice need please?

    Hi,

    I'm wondering if anyone can please offer some advice.

    I have a 5 year old daughter who lives about 60 miles from where i live. I have also had a court order since 2011 regarding contact and other things. In the whole the order has been abided by mum bar maybe one or two one off occasions, which is no biggy.

    The order states I get to have my daughter every other week, from Friday after school until Sunday afternoon. Anyway the last time I went to collect my daughter she was very distressed (she's normally fine) and we ended up cancelling contact on that weekend.

    Fastforward Thursday just gone, mum text to say she had asked our daughter if she wanted to go and she said no so she was cancelling contact again that weekend. I remonstrated, claiming a 5 year old shouldn't be making those sort of decisions, but to no avail. Anyway today I got a further text message from mum saying that she will no longer be not be allowing our daughter to travel to Manchester (where i live) from Stoke (where she lives) during contact.

    She know exactly what she is doing, she's not cancelling contact but is effectively cutting it short. Because I won't be able to take our daughter back and have her overnight contact will be restricted.

    Just looking for tips on how I can deal with this. Obviously I want to avoid going back to court at all costs and will consider going back as a last resort. If it comes to that, how long should i wait? I know how backwards the Courts can be? What i don't want to happen is allowing contact to be disrupted for long, whilst trying to sort matters out, and then that goes against me and it's then considered the 'norm'.

    Any sort of advice will be much appreciated.

    Hi tombeloro,

    I can only suggest contacting the Cafcass officer and asking for their input. Perhaps mediation might help at this early stage before, as you say, things get set into a new pattern.

    Families Need Fathers http://www.fnf.org.uk/ might also be of help.
