  • Contact Order Broken? Advice please

    Hi,

    My gf was taken to court by her daughters father, where a contact order was arranged. The father was the applicant in the case.

    This weekend, the father should have had his daughter between 9:30am Saturday, returning her at 3pm Sunday. What actually happened was his own father picked her up and dropped her off, and she stopped the whole weekend at her grandparents without her dad being anywhere near (his dad claimed he had a work conference to attend at the last minute, but the daughter said when she spoke to daddy, his gf was with him too).

    He never advised my gf that his dad would be collecting and that his parents would be having her all weekend.

    The order states:

    "The respondent mother will make the child __________ available for contact with the applicant father as follows....."

    and

    "And it is recorded that the applicant father shall be responsible for the collection and return of ______ in respect of all contact visits."


    Now does this mean based on what has happened that he has broken the contact order he has pushed so hard for?

    If so, what steps can now be taken?

    hi fellow don't think you got much to shout about
    the court will always think of the child
    Lets face it if the grandparents asked also to have contact order it could be granted

    It is difficult when parent's separate

    However it is in the interest of the child to see as many members of the family as possible

    The Judge I feel would take this stance

    Regardless if the father had to work and did not personally have contact he insured that nan and granddad was able to see there grand child


    If it was the fact that no one had come and became regular thing and dad just did not bother that happens in lots of cases you could have a point

    My view after going through this you don't stand a chance the judge might feel the dad has done all in his power to keep contact with the child's grandparents

    And believe me you might not think so now but soon this will be important

    My advice would be to let the child have as much contact with all sides of family as possible with out using the courts
