Hi, im wondering if anyone can give me some advice.
5 years ago my ex wife got married and took my 2 children to Spain to live. she rang the CSA and told them she didnt want any monies off me as she was emmigrating. they then rang me and informed me that she was no longer asking me for money and the case was closed. (this was done by an attachement to my earnings as i was in the Army at the time.)
With this i was able to save up for a deposit on a house and get a mortgage for me and my new family.
In January this year, 2014, she split with her husband and moved back to the UK. She then rang CSA and asked them to claim child maintenance for my daughter, who is 18 and in full time education, 16 hours a week.
They rang me and told me i had to pay over £400 a month to her and that if i didnt they were going to get an attachement to my earnings, (I currently work for a government based company).
I asked how they worked out how much i had to pay and they told me they go to HRMC find out how much tax i paid for the previous 2 years, get the average and work out how much i had earned. (bearing in mind i have a taxable pension from the armed services after serving 22 years).
I rang them and said i had a mortgage now and i had budgeted for, and that i had 1 x dependent living with me who was under 16.
They gave me a discount for her but refused anything for the mortgage.
I told them i could not afford the payments.
I was told to speak to my mortgage company and arrange something (less payments) or sell the house!
Under the old CSA scheme which i was under 5 years previously, they would have taken into consideration my mortgage and expenses but as it was a NEW case they dont do that.
I do not mind paying for my daughter but think this is wrong in some way as once she said she didnt want child maintenance that should have been that, and especially since shes 18 now.
Frustrated!!!
