  • Changing my sons surname

    Hi

This is a bit sensitive for me, my son has his fathers surname.

The problem with this is that his father has been convicted of sexual crimes (against minors) and is currently on the sex offenders register for 10 year from 2009. The judge also said that he was allowed no access to children under the age of 18 without parental consent, so lo and behold I took this as a perfect opportunity to get away and my son has not seen his father since, the last time he saw him he was 10 months old!. My ex was also mentally abusive to me (I can prove this with social workers, health visitors and doctors).

However I am with a new partner and want to change my sons name to that of mine and my new partners to protect my son (ensure his dad doesn't find him or us), the fact he is on the sex offenders register for 10 years means I do not want people associating my son with "father" and want stability for him with my new partners name etc.
I am concerned that we may be found and ensure things like he is never in a public pictures, school magazines and social media etc, but for his own safety it would be better to change his name,

Can I do this on the grounds his father is a convicted sex offender, we are scared/worried he will find us, I don't know where he is to ask for consent and I do believe he wouldn't give it anyway as it would be his way of having a life long tie to us/me.

    Hope this all makes sense

I may be wrong but I was told that you can only change the surname with the consent of the other parent (if living) . Once your son turns 18 he can do whatever he wishes
