Right; the ex and I divorced about 2 years ago. She hasn't lived at this house for 3 years+. Initially when we were splitting it was fairly amicable and I originally intended on buying or building a small dwelling in my garden (it's quite large) but then as things sunk in I realised I was being a fool. Then I decided I was going to move out, rent a place and pay for the mortgage on the house we shared as we had a couple of kids under 5. Now, after working everything out over a period of a few weeks in my mind, with friends, family and people who just wanted to put their nose in to my business, it became apparent what the real crack was. I earned the money mostly although she had returned to work but like all things, it was spurious and only for as long as she could be bothered until something new came along to peak her interest. This is just the type of person she is, nothing lasts for long.
Any-hoo, the house is in joint names on deed and mortgage, she hasn't lived here for 3 years as she moved out and I was guarantor on her rented place(s) just so I knew the kids had a roof over their heads when they are with her. We have the kids on a weekly rotation. My girlfriend and step-son moved in and we are a happy family, especially when the other 2 kids join us on their week. I've finally gotten the money together to pay her off the £5k she wanted as the house was in negative equity and now I've gotten the CHOO (Change Of Ownership forms for the deeds) for a new mortgage and she's told me she's not signing them until her solicitor has put in place something to do with the kids getting something out of the property should I croak it. She already has the funds in her bank account, I might add!
She's very bitter about the property and feels hard done by. The fact that I have paid not one, but two mortgages, sometimes at the same time and she hasn't put in a penny for about 7-8 years (I can prove this via bank statements). I already over pay her by £100 for child maintenance and she's also remarried almost a year ago but she won't let go. It's killing me and breaking my current relationship because she just won't take her teeth out of the cash cow, aka me! We've had wrangling over the kids and the fact that she feels I should only get them about 7 days a month due to my working late, but I'm always home an hour or two before bed time and the kids love their step-mum to pieces, and vice versa. The legal stuff has only ever bounced around the solicitors and hasn't gone any where near court yet but it's not to say it won't.
So, back on track. The house. Can I force her to just sign it over? I've paid her what she wanted but now she's adding clauses. One thing I might add, she signed a Quit Deed stating that if I paid her £5k then she would relinquish all rights to the property. This is still with my solicitor and I never followed through to get it stamped at court due to the fact that I finally managed to get a mortgage and funds together with the house even in negative equity to get bailed out.
