  • Advice please on Grant of Confirmation timescale in Intestancy case

    My father died intestate on Mother's Day. My Mum and I visited the solicitor 10 days later and my Mum nominated me there as the executor of Dad's very small estate (£7000 from Insurance policies, £2000 from the joint current account and 1/2 the house). To further complicate things, we discovered at that meeting that the deeds to the house Dad owned with my Mum (his share is £60k) were not written with a survivorship clause.

    Sods law is that my Mum and Dad have had their house for sale for two years and Mum finally received an offer two weeks ago. She in turn has put in an offer to buy another house (one with vacant possession), with exit/ entry dates of 29/7/13. The solicitor explained that effectively my Mum would be selling one half of her house and I'd be selling the other half as Dad's executor. However in order for me to do this I need to first be approved as the executor by Kilmarnock Sheriff Court. I was advised by the solicitor on 23/5/13 that this request had been submitted. Once I have been approved I will still need to obtain the Grant of Confirmation from the Court to allow me to sell the house.

    With the sale dates being only 6 weeks away I am worried sick that this won't happen in time and that my Mum, who will be 79 on Friday, will have nowhere to live. She shares a house with my sister, who has special needs, and I don't have room to take them in. As of next Monday, there will be a 3 week period where either myself or the solicitor is not available due to our respective holidays abroad, leaving the final two weeks in July for it all to fall in to place.

    Sorry for this to be long winded, but how long should it normally take for the Court to approve me as executor and issue the Grant of Confirmation thereafter?

    Hi Gizasmum

    I recently and am still in the process of ingathering my Mother's estate. Once you are appointed Executor and have applied for Grant of Confirmation it will take about 10 days to go through Court.

    Hope this helps reduce the stress levels. Sorry to hear about your Dad and my sympathies to you and yours.
