Reclaim care costs for free
Changes to the assessment rules for care home funding in England could mean that patients can apply for a refund on their fees.
Previously, in England, each health authority used a different set of criteria to assess the funding a patient was eligible for. However, since October 2007, the rules for assessment changed and one system was implemented for the whole of England.
This means that if you received care anywhere in England because of a "primary health need", the NHS must pay the entire cost, without means-testing. This is regardless of how old you were when care was received, or how much you had in savings and assets. However, this clear exception for those in England is not widely publicised and many older people in England and their families have wrongly paid out for NHS or private care.
If you believe a relative was wrongly assessed, before October 2007 or since this date, you may be eligible for a refund, even for relatives now passed away. There is an urgent deadline and if you qualify, you must start your claim by 30 September 2012.
