  • Problem with shared house

    Hi all

    Basically I need a bit of advice regarding a house I have in Australia.

    The situation.
    I was in a relationship with an Australian girl. We built a house in Australia, which her mother ½ owns, and myself and my ex partner both own a ¼ share of. We each pay a proportional share of the mortgage repayments. Our relationship ended and I returned to the Uk while she remained in Australia.
    Now she is living in the house and we all continue to pay the mortgage. I would like to rent the house out so that it will repay the mortgage or at least provide a source of income. She is saying, along with her mother that she will not do this and will not move out, or accept tenants. She said I can move back in but obviously she knows this would not work so is calling my bluff.
    Her mother has offered to buy me out, but at the original cost of the house (less mortgage) plus my share of the deposit. I do not want to do this as obviously it would not be in my financial interests considering the investment potential of the property. Does anyone know my options (if any) in this matter? I would reeeaaaly appreciate any help as I do not know what to do.

    Can your ex rent your portion of the house from you ? So you retain ownership and thus the equity accruing and you have an income from the property. Or has that suggestion already been written off by your ex ?

    Was any agreement drawn up prior to the shared investment?
