Good morning all and thanks again Tuttsi for directing me to the thread.
Ok. Lets go:
I discovered in July 2009 that my husband was fraudulently claiming income support, housing benefit and Council Tax benefit after I informed the authorities that we were living together as from July 2009. I work full time on a good salary and the property we live in is owned by my husband (at least I think it is). He tells me that his deceased mother's name is on the deeds. She left the house to my husband and two of his three siblings. A sister is disabled and in a care home. My name is not on the deeds. I have not had sight of the documents. My husband is being investigated by the council for the fraud and is required to repay the benefits he wasn't entitled to. The investigation started in July 2009. My husband is from a legal background (solicitor) and very aware of loopholes within the benefits system.
I have my own property which is on a mortgage in my name only. The house is unoccupied but furnished.
I recently found a council tax summons for £957.00 for the property I currently share with my husband and my 14 year old daughter from a previous marriage. My husband had hidden the summons. I demanded that my husband paid half of the council tax arrears and he did via a credit card cheque to me. I am concerned that if I had not found this court summons, the courts would have directed a Liability Order and the debt would have been retreived via an attachment to my earnings.
I have informed the council that I will be returning to my own property by the end of the financial year 30th March 2010. This will be my main place of residence. I will also complete the voter registration form for the house I own. My daughter attends school and has a paper round near the property which I currentlyshare with my husband. Will I still be responsible for the council tax at the property where my husband lives? As I said above my name is not on the deeds. I do not plan to commence divorce proceedings although I am very annoyed with my husband's deception.
I am concerned that the council will conclude that I am moving back to my home address to avoid paying Council Tax on the property I currently share with my husband. A further concern is that my husband has indicated that he has no intention of paying the next council tax bill and he intends to put a charge on the property I own so that the council can obtain any future arrears from me. In addition, my husband has informed me that I would need to show proof that I was no longer living with him by having my mail directed to my home address and changing my GP to one near my own house. I am aware that one has to change GP if you move out of the catchment area but need clarification on what else I need to do to avoid paying council tax at an address which is not my permanent home.
I do believe that my husband is choosing not to work due to the fact that he would have to increase the installments for the overpaid housing benefit, council tax and income support.
I am still puzzled as to how my husband could get away claiming housing benefit when the house is supposed to be owned by his and his brothers. There must have been a false claim for housing benefit. Furthermore, how has he managed to obtain a credit card with a limit of £12,000 when he's unemployed!!!!!!!!!!
Anyway your help with sorting this matter would be appreciated. I am very hard working and don't want to loose all my earnings to a husband who is trying to bleed me dry.

Theres a few issues there that need sorting. First of all you cannot be held liable for his debts by the council once you no onger live there. Make sure that last years council tax is paid, don't just take his word for it. As for putting a charge on your house he will have to go to court and he should well know that given his profession. As far as I can see he has no grounds to do this. Once you have moved make sure you have no finanancial association with him, check all your credit reports and I would suggest that you subscribe to experian @ £6.99 per month to keep an eye on them as he sounds like the type of character that would use your identity to get more credit.
You say you are not divorcing him yet why?
With regards the benefit fraud are you being investigated as a partner who knew about it?

I can confirm that last year's council tax bill was paid. I made him give me his half of the debt and paid it last week. Got receipt too.
Do you know what, I am registered with Experian Credit check service and it was only last night that I requested another user name. Not used the account for a while but I seem to remember them sending an alert about my credit rating. Will check that out.

Is there a reason that you wish to remain married to him when he in fact he could drag you down with him?
