Executor Legal Fees (Scotland)

Hi everyone, hope you can help.

My father passed away (in Scotland) last year without a will. Since then, I (his son) have been the executor of his estate.

I appointed a solicitor to deal with the necessaries. It's a small estate, and it's likely there won't quite be enough money left in the estate to cover debts.

I have a concern around legal fees. I could just ask my solicitor about this (but conscious of cost!)...

Will I be responsible for the legal fees, seeing as I appointed the solicitor, if there is not enough left in the estate to cover them?

How were you decerned executor - petition for appointment or using the small estates procedure?
