  • Family Court - F14 Warrant of citation in family action

    Hi,

    I recently signed up to see if I could possibly have some help with a couple of family issues. Here is the background.

    I split from my partner a few years ago, he has had access to the children and has taken them on his days off work. I have been asking for set days for around 12months and a couple of months ago I received a F14 warrant of citation in family action. I defended this and ended up in a family court over a few visits. I now have set days - set by the court, I am happy with this arrangement. The court is now sisted at present. I have had several other issues along the way, but I have been reading more and more information on Family Law. I am wondering how he has managed to take me straight to a family court without attending any mediation. My lawyers fees were 4K, and have recently parted ways with my lawyer due to a few conflicts. My ex partner has had 2 lawyers previous and now on his 3rd. I found out he is "suing" his original lawyer - I have no reason why. I would like to know if I can take my ex partner to court over the F14 citation as when we went to the family court he was awarded 3 days a week and ended up saying he could not commit to so much time, so was reduced to 1 day a week. I feel like I have had to defend myself and pay these fees for absolutely no reason apart from the fact he wanted to financially hurt me. Where do I stand? Its not over yet but I am now representing myself and have send letters to his lawyer 8 weeks ago, and have had a reply each week stating the lawyer has not received any instructions from her client so it seems he has stopped talking to his lawyer. Would a lawyer take this on to try recover some of the 4K if it is seen to be deliberate going to court purely to damage my finances. I have agreed to his lawyer I would attend mediation but this still hasn't happened and that was 6 months ago - so presuming it wont come to fruits.

    Hi Wingnut19,
    Having looked up what an F14 is I note it is Scottish Law. Unfortunately we are predominantly Eng/Wales specialists I'm afraid. I wonder whether the rules are different up there. Mediation is expected in Eng/Wales and generally can be avoided in very limited circumstances such as domestic violence situations. I'm not sure on the Scottish law position. I will tag ScottishSolicitor who may have some more knowledge, but not sure this is his area.
    The other option would be to contact the Scottish CAB who may be able to assist you here: https://www.cas.org.uk/

      I am not a family lawyer but I suspect taking the action contemplated would be a waste of time.

        Thanks for the replies. I thought as much unfortunately.

        My case is currently 'sisted'. Can i apply to the court to reopen and return. Contact is not working out atal and would like to go back and have them review. I have already tried to negotiate through lawyers but its going round in circles so would like to return to court again. Can I apply for this to be reopend myself? Any direction on how I can apply? I will see the CAS tomorrow but would like to have a look myself first before the meeting.
