Hiya,

As you know I jacked the call centre in, I never got my final wageslip (so have no idea if I have been paid up to date) and have never received a P45.

Any idea of the legality of this?

Thats the main problem. I don't know and dont know if I'm owed anything because I don't know what dates the last wage slip (i was paid 26th Sept- left 22nd sept so I assume I missed the cut off date for the full month) and I know I am owed holiday pay


***UPDATE*** my work best friend has told me that the wage slip covered until 15th Sept and I left on 22nd so I am owed some money I assume I will get this on the 27th Sept

Has any money gone into your bank account between you handing in your notice and today does it seem to be roughly what you were expecting? When you handed in your notice did they acknowledge receipt and give you details of what you would be receiving and when - I have a feeling you are going to tell me they did not!

Would they have had a "payroll run" since you left? Some employers if you leave in the middle of a pay period will still pay what is owed in their normal pay run which means you may not get your payslip and P45 until after that pay date?

By law you should get a P45 so I would suggest that if there has been a pay run since you have left you get in touch with them and ask them to provide it to you and your payslip

I wasn't even properly escorted off the property when I left, no leavers meeting or anything! Just made sure I had handed everything in. I've been told the payroll run was 15th October by a former colleauge but have had nothing since. I was owed in the reigon of £430 (ssp @ approx 90 pw + 1 week wage whilst on holiday before sick leave) and I was paid bang on £430 but I didn't know I was leaving till 17th Sept (roughly) and didn't hand my notice in until 22nd Sept so I am def owed until then!

No one told me anything about wages or when they would pay me my final wage.. no idea

Did you give contractual notice when you handed in your resignation on 22 Sept? If so how long was your notice period?

I gave a week notice, they now say they processed me as an immediate leaver, also just remembered, when we started we worked a 2/3 weeks in hand cos we missed the deadline, so even if they did stop my wages on the day I left, I'm owed that too ?

That can't have been added to my 15th Sept payment as no one knew I was leaving till 17th ish

For my learning; which statute or case-law would a claimant use as jurisdiction in the ET to take the employer and make them give up the P45?

P45 isn't really a problem as when you get to your next job you will be on emergency code, probably the same as your current code.

I think sit down and do the sums is in order.

The requirement to provide a P45 is contained within The Income Tax (Pay As You Earn) Regulations 2003.

On the 2/3 weeks in hand have a look at your first payslip and check it was not included.

If you gave them a week's notice (if that was what you contractually had to give) then you should not have processed you as an immediate leaver - you did not leave due to gross misconduct.

If payroll is on the 15th of each month and you resigned on 17th Sept all your final monies should have been paid in the 15th Oct and you should expect your final payslip and P45 any moment.
