In 1999 I signed a contract of employment giving me 25 days annual leave with a clause saying i would then get the additional 8 bank holidays giving me 33 days total. When legislation changed in 2009 raising the minimum leave to 28 days we were not informed of any change in our leave entitlement and so we now appear to be having to use bank holiday leave to top up our annual leave. Is this acceptable or should our company increase our annual leave to 28?

The statutory holiday entitlement is 28 days for a worker working a five or six day week. Any days off for public or bank holidays will count towards a worker's statutory holiday entitlement as long they are paid for those days off. Therefore if you are getting 33 days paid holiday inclusive of bank holidays you are already receiving more than the statutory minimum requirements.If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com
