    Hi all,

    I am in the position of having been instantly dismissed - after 20 years - for gross misconduct. I have the right to appeal within 7 days. I DO NOT want to go to a tribunal or any such court hearing, as the stress so far has been quite enough! However I would like to appeal the decision, as I think instant dismissal was unduly harsh for the offence I was accused of. My question is - If I appeal the decision, asking for a settlement payment and a neutral reference, must the company simply say yes or no? Would they have the power to take it any further through courts or hearings? The very thought of such proceedings is stressing me out and may prevent me from lodging an appeal.

    If you appeal you are asking them to reinstate you and not pay you off.

    Incidentally the the company may only give neutral references only, I know of at leat one multinational that does that, whatever the reasons for leaving were

        HI,

        For three months less one day the you bask in the warm sunlight of the RIGHT to have a judge review the decision of the firm. The judge would expect you to try ALL internal procedures first: I STRONGLY recommend you appeal, on paper, if called to a meeting take a colleague (do not be embarrassed: you were a salesman...).

        Appeal internally then take a few weeks to calm down. But do appeal. Come back to the site after the appeal. But do... Oh, am I getting boring here...

          I appreciate your advice - the 7 day time-slot for appeal ended Wednesday! Do you think it is still worth an appeal by email? I have just learned that they were seeking my replacement for some time, and he starts Monday...

          It feels like a stitch-up...
