Employer has turned up to my house

Hi,

So I am on a days annual leave and my boss has turned up at my house and terminated my contract verbally. He has taken my phone and keys and said I have a weeks notice on my contract.

He hasn't told me a key reason for wanting this to happen but said he can 'put it down to a clash of personalities' and that he will give me a good reference.

I'm unsure why I should resign or anything as I am certain that I have not committed any act that would warrant sacking on any grounds of misconduct but I have worked for the business less than two years.

Could somebody advise me on what may be the best course of action here. This does not seem right nor was it expected, although I am aware the businesses finances aren't good.

How long have you worked there? Ok less than two years ( sorry misread that bit ) - how much less than two years ?

Has anything happened at work recently ? or you think it's just down to financial pressures?

Hi,

So about 7 months actually. There has been some what in the office due to wages being unpaid or paid in instalments along with some details about the owner and a previous member of staff withholding important information.

I still was not ready for this morning though...

This is not a very professional way to deal with the situation. Unfortunately though as you have less than 2 years service with the company this often leads to employers not using their usual disciplinary, capability and redundancy procedures when dealing with the dismissal of an employee.

You would have some recourse of action if the company had a dismissal processes which was contractually binding. This means that if they do not follow their own procedure in dismissing you then there may be the possibility of a claim for breach of contract. There is no qualifying service requirement in order to bring a claim of breach of contract.

Thanks for the advice. Given the circumstances, would you advise I resign or withhold my resignation until commitment on what I will be paid and when is given to me in writing?

So if your boss has terminated your contract then I it would be too late for you to resign. What you do need to get is confirmation in writing of what they are going to pay you and what wording they will use in any future reference they may be asked to provide.
