I have a non compete clause in my contract it specifically list business I can't work for for 3 months after my employment termination.
Heres the slightly complex part
The company I want to work for is listed and I used to work for them 6months ago, I am not enjoying the new company and my old company have offered me a position.
The old company have a pool of contractors they use some are ltd company's, one has offered for me to work for them directly and be an employee of his firm until my non compete is finished, but essentially I will be working for the old company as a contractor for a period of time.
Is this possible or would it be likely I am in breach of my non compete?
