  • Tribunal claim - respondent details advice please

    Can anyone give me some guidance on who I should put down as the respondent and the address please for an ET claim?
    This is just for the Early Reconciliation stage at present.

    Should it be:
    - the name of a person, ie the employees manager and the address of the place of work
    - the name of the company and place of work
    - the name of the owning company and the address of the head office

    I just spoke to ACAS and they said they cant advise but it is important to get it right or the claim can be thrown out!!???

    Hi is this in connection with the other thread that you are running? In which case due to the nature of the claim then it needs to be the details of the legal company employing the person. The first place to find these details is on a payslip or contract of employment.

    If you cannot find the information that way then look through any correspondence (emails, letters etc.) that have been received from the employer and there is also the company's website that can be checked.

      Yes it's the same...

      The claimant works at location A, there are other locations which all have different names. My mate occasionally worked at location B and C but his payslip always shows location A as the employer details.

      Ultimately they all fall under the umbrella of a limited company for whom I have the address.
      I shall use that as the company name and also that address.

        In that case yes you should use the limited company name and address as the Respondent.
