Hi , this is a brief but accurate account of the problem I'm having, any accurate legal advice would be most appreciated, thanks in advance!
Car went into the back of my works van while I was parked.
Employer tried to put accident down as working from home to falsify Lost time accident figures / to save paper work ect.
Invented doctors appointments I'd been to and what the outcome was. (Have email proof of this)
This lead to work coming to my home whilst i was signed off by the doctor, and in severe pain and whilst on medication, to conduct a 90 minute investigation into the discrepancy between my version of events and my managers.
Contacted union, was told to tell the investigator the truth, which I did, naming the manager in question and the manger above him he said he was going to clear it with.
Contacted the company's occ health scheme but no one gets back to me.
I had a months annual leave booked in for the end of the week, so sent emails to find out my duty and the return to work policy should I be fit to return after a month long annual leave , no reply sent two more emails that week, no reply.
Landed back in the U.K. 3 days before I was due to be back at work, emailed them again stating I was still sore from the accident and needed to know mine and the companies duties involved in the return to work process , no reply , asked again the day before due to go back no reply again.
First day back and I'm booked in for a full shift of work plus all night call out, raised this with my coach , nothing changes, end up being booked in to work 10 out of the next 11 days solid.
Company breaks the working time regs/ their own policy giving me late working after ive opted out for the day, due to still being sore from accident so as to try and aid my recovery.
Coach falsely invents return to work meeting and back dates it to comply with policy( which I can prove)
Ends up I'm at my wits end and send a very frustrated email to my boss regarding the lack of support I'm getting, leads to a phone call from him telling me I'm wrong !
I end up having a nervous breakdown over it all and am rushed to hospital, im currently signed off by the doctor waiting waiting on another phyc assessment.
To add to things my wife is a foreign national, we've just been married , hence the month of annual leave, I can't work due to the breakdown, and now I don't earn enough on statutory sick pay to apply for her live to remain visa.
Basically my employer is a top 30 rated company on the ftse, and have extensive policy and procedure in place in these situations , no of which have been followed and life and health has sadly suffers to the point that I don't know if either will return to how they were, as you can imagine I'm in a severely distressed state.
