I work in an amusement arcade this morning when I opened the shop my boss was waiting for me and asked into his office his sec was sat there I was then asked have I switched any machines off which we do Fromm time to time eg machine gone wrong owing money to customer awaiting mechanic to fix or resolve anyway the crux I have switched one machine off four times in last month asked why explained that it keeps crackling like there is a fault eg could set on fire my problem is that I didn't tell the mechanic I forgot I did mention it to the boss at one point and I didn't write it in the book which we normally do if something is wrong this is the reason for suspension as I held my hands up and said yes I should have brought to the attention of mechanic I don't know what they are investigating I only did it because of safety reasons we have no access for money purposes etc there is no reason I would switch of for any other reasons than safety although the boss seems to think that there is nothing wrong with machine as its brand new a rolls Royce of a machine and they have never had a fire in all the years they have been open I have been lax in not informing correct person but do I warrant this I now have to wait till they get in touch with me I have worked for them for around 15yrs this is very upsetting and I would like to know were I stand can you help me pleaseeeeeeeee

Being suspended happens when an employer wants to investigate allegations of misconduct, which in this case appears to be switching one machine off four times in last month without following the correct process for notification. Even though you accepted the situation they still may want to carry out an investigation. Being suspended is not a punishment, but part of the investigation process in a disciplinary procedure for many employers. Your employer should give you a clear reason for the suspension, let you know what the allegations are and if they did not provide anything in writing at the time they should follow it up with a letter to you.
Your employer needs to do what they can to resolve the issue swiftly and keep the suspension to a minimum. Your employer should keep the suspension decision under review.
Unless there is a clause in your contract that says your employer can suspend you without pay, you should receive full pay while you are suspended. Most suspensions are on full pay, even when part of a disciplinary process.
I know that it is really hard but until your employer has carried out their investigation you will not have a clear idea about what, if any further action they will be taking. Had to go and collect the letter today as it didn't arrive in the post its of the mins taken it is basically what I said to you 50mins of asking the same question why have I turned the machine and my answer because it keeps crackling and holding my hands up that I should have reported it there are a few discrepancies and slightly out of content so they read differently should I circle these firstly at the beginning of the intervention they asked me was there anything problems outside work health issues etc that might affect my ability to carry out my normal duties they have put this in near the end of the interview I answered no as I thought they would use this against me but Warwick my boss knows I'm being investigated for bowel cancer and having tests on my heart as my pulse is racing and I'm also looking after my mum who has got end of life heart failure another thing they said in the interview did I not think by the machine being switched off that this would cost the company money I explained that no as it is a small shop only 24machines 97% of customers are locals and regulars and I know all of them by name their children's names even their pets names etc if a machine has an out of order sticker or switched off they will ask the reason and can they play it I also know which customer plays which machines so that if a customer that plays that machine came I would switch it on as the machine has had a rest from the crackling so I can categorically say that Warwick has not lost any monies I have switched another machine off for the same reason and firstly they kept saying nothing was wrong with it but eventually they found a problem they leave machines off for days sometimes as the mechanic can't get there or its his day off so it's two days before it comes back on that have put a sentence in John Warwick says it's the speaker isn't it(the crackling) the interference I replied yes it's like that and that spells fire to me they have written it's the speaker sound isn't it and I have supposedly replied yes and then it's like it smells fire to me that means fire there are a few more discrepancies but they don't alter the way it reads on the ctv the machine was switched off for 5hrs on the Monday I just held my hands up I've forgotten it Warwick what I should have said its most probable because I've just worked a 9hr shift and then a 12hr shift with no breaks not even a toilet break you do get tired and forgetful when you are doing those sort of hours without a break especially at my age I'm 63yrs old I'm sorry I'm just waffling this has so upset me I feel so injured by this I have always tried to do my best for him sorry for waffling what should I expect next and do I need to do anything thanking you mimmy

They will get in touch very soon regarding the next step sorry looking back at the previous reply it was rather mixed up and didn't make a lot of sense basically it was asking me over and over again why I switched machine off and my reply and why I had not reported it and the other was that he could lose money for the times it was off and my explanation of how he would not have lost anything what should I expect to happen in the next meeting and should I say anything sorry for the ramble yesterday just so upset calmed down a little now

Thank you for posting the further information you now have. It sounds like you received the notes from the meeting you had however did you also get a letter confirming that you have been put on suspension and whether this is paid plus given you a clear reason for the suspension with details of what the allegations are? Did they also give you any indication as to how long the investigation will take?
The first thing you need to do is go through the notes and make sure they are an accurate reflection of the meeting that took place. If there is anything that is incorrect (which it sounds like there are) or things that were said either by your manager or you that have been excluded you need to make a note of them - this is quite important.
I agree with [MENTION=8640]leclerc[/MENTION] it would have been good to mention the medical investigations that you are under at the moment particularly as the manage specifically asked about it. However I do completely understand why, under the pressure of the situation, you felt that it may cause more issues by mentioning it.
Also can you clarify the 9 hour shift then the 12 hour shift. I'm guessing you are saying that you worked each shift without a break but what break did you have between each shift?
What should happen next is that once they have carried out the investigation then they should contact you to let you know what action, if any, they are proposing to take as a result.

We work a 12hr shift a 9 hr shift and then 3 5 and three quarter her shifts we do not get any breaks tea break dinner break toilet break if we need the toilet we have to wait until it is safe eg customers that we trust watch while we nip upstairs it never used to bother me but the last year I am finding it hard and yes I get tired and then you don't think straight

Just as an aside to the main issue on the 9 and 12 hour shifts it is illegal for you not have a break. You are entitled to an uninterrupted break of 20 minutes when daily working time is more than six hours. It should be a break in working time and should not be taken either at the start, or at the end, of a working day.
