    II have a contract of employment with "company 1" but the MD of that company also has "company 2"

    If I'm asked to work for "company 2" covering for someone who is on annual leave, but I'm still getting paid by "company 1" do I have the right to decline the work?

    I have to admit this is not something I have come across before so I can only offer practical suggestions. Not being aware of the dynamics within your company I am not sure how this would be taken but I suggest a discussion with your MD about the situation. Some things to consider are how would your work be covered as I presume your job still needs to be done, are you confident in your ability to do the job being asked of you, is there a location issue?

    I am also not sure where your MD stands in regard to his/her obligations and statutory records in regard to you working for Company 2 but being an employee and paid by Company 1.

      Are they both ltd companies? Is on a subsidiary of the other! If they are completely separaste, it could even be that working for company 2 is in breach of your contract of employment with company 2. Is there a particular reason for you wanting to decline the work with company 2, assuminmg its within your normal hours of work and you are getting paid as normal?
