    Hi,
    My wife is a nurse who is contracted to do 30 hours per week. She is employed to work night shifts. Two years ago family circumstances meant she needed to fix her shifts. She has done this ever since and has a colleague who has also fixed her nights.
    Recently her manager has been - IMHO - very unprofessional with her. She referred my wife to Occupational Health based, as per her referral email, on something she'd heard. When my wife attended the Occ Health nurse had no idea what she was there for but was horrified at the way she had been referred.
    Now, following a recent meeting, this manager has said she is going to look in to employment law as she feels my wife is not showing enough flexibility.
    There's a bit more to it, such as her manager always requesting a meeting during day times when my wife is off shift, or more recently asking her to present to the Board at 2 pm following her shift the night before. My wife completed the presentation document but told her manager she couldn't come in to present it as it would be akin to her coming in at 2 am and then starting a shift at 0900. She got a mouthful in reply.

    Anyway, I was hoping someone could point us in the right direction of where my wife stands for all of this please?

          Even if your wife's contract just says '30 hours a week'; the fact that she's worked the fixed night shifts for 2 years means that these shifts are now her contracted hours.
          This was achieved both by a mutually agreed variation of contract (even if not documented) and by custom and practice.

          If her manager looks into employment law she might find s.10(1) of the Working Time Regulations 1998. Perhaps she'd like to address a mouthful to Parliament.

          As for the Occy Health referral.....what the hell was she playing at?
          Did your wife get a copy of the OH referral document and the OH report?

            Hi. Thanks ever so much for this. Unfortunately the manager is refusing to give my wife a copy of the referral and occupational health won't hand it over without my wife gaining consent of the manager!!!

              Others will know better but would a SAR or an access. to medical records act request providw,the,informarion that you need
