  • Striking out ET response

    Hi All,

    If I want to make an application to strike out the respondent's case in the Employment Tribunal, is there a form I have to complete or can I just send an email?

    Also, do I have to go into detail why i'm asking for it to be struck out, or will the overall reason, i.e. no reasonable prospect of success, suffice?

    You can just send an email to the Tribunal and the Respondent citing s.37 of the Employment Tribunals Rules of Procedure.

    Unless it's completely obvious to anyone comparing the ET1 and the ET3 that the response raises no reasonable prospect of success you should give as much detail as possible.
