Notice period

Good evening,

I'll keep it brief - been working for a company for 11 months, very unhappy in role as overloaded with work, excessive working hours and bullying culture. This has made me ill so I have taken some time off. I have handed in my notice (to no response as yet) offering 4 weeks notice under the circumstance. My contract asks for 3, but I am not going to be able to do that in light of the circumstance.

Any advice?

If you're being bullied and feel that the working environment is no longer manageable for you, you can leave the company and take them to the tribunal, ie for constructive dismissal. About the excessive hours, the Working Directive should limit your hours to an average 48 hours a week. You may have waivered this right though? Have you?

Thanks for the reply. No, I haven't waivered the working hours right. I just want to leave and chalk it up as bad experience - my only worry is the notice period. I know it is unlikely many employees are pursued but just wondered if anyone had been?

Hi Louisa78,

My understnding of employment law is that you need to 2 years service to acquire employment rights and go to a Tribunal unless you have a case of discrimination. In light of the above I think you need to speak with your employer raising your concerns and posible agreed a mutual leaving date that will be suitable to all parties.
