I will make this as brief as possible initially, but happy to fill in the blanks as necessary.
Recently made redundant after 10 years service.
Redundancy was with immediate effect, so no notice and holidays outstanding.
The employer owes me wages.
I have calculated that I am owed the following (rounded figures):
Unpaid wages: £6500 (taxable)
Redundancy Pay: £3200 (tax free)
Pay in lieu of notice: £3200 (taxable)
Pay in lieu of holidays: £1600 (taxable)
Total: £14500
I am still in negotiation for this, but if it does come down to me taking court action I am wondering what my options are.
Do make one claim for everything, on the understanding that it is allocated to fast track, rather than small claims as it is over £10000. Other than the cost, what are the other implications that I need to be aware of?
Or, do I make two separate small claims as follows:
Claim 1: Unpaid Wages: £6500
Claim 2: Severance pay: £8000
What about tax & ni contributions for the taxable amounts. Would I claim the full amount before tax and then pay this to HMRC?
