  • Redundnancy - Can I still recieve payout if my appeal is upheld

    Hiya,

    I am being dismissed by reason of redundancy by my current employer. My employer has given me a 12 week notice period as required in my contract, after such time I receive a statutory payout. The original terms of redundancy also state I can hand in my notice (4 week notice period) and this will still be classed as redundancy and I will receive the payout.

    I have a new job offer and have handed in my resignation, therefore will be formally 'redundant' in 3 weeks time.
    However I have an ongoing appeal in place with my current employer against my redundancy. If my appeal is upheld, will this then mean I am no longer entitled to the redundancy payout if I decide to pursue the new job?
