    Hi all,

    I have a few questions regarding my rights as an employee.

    The company i work for operates a policy of a grading system for employees. N1 grade for new starters upto N4 for lead operators and OM's (Ownership Maintenance Operators)
    Each grade has a set rise as set out by company T&C's. With the introduction of the National Living wage, my company only saw fit to raise the wages of the N1 graded employees to comply with the said change. Should they have not reviewed everyone's salary at this time in line with there own T&C's of employment and grading system?

    Hi bones76 welcome to our forum.

    In answer to your query from 1 April 2016 the government introduced a mandatory National Living Wage (NLW) for employees aged over 25 years of age of £7.20 per hour. This would have meant that your employer would have had to ensure that this was the minimum hourly rate they were paying staff aged over 25.

    Within your company's T&C's does it state the date each year the various pay grades are reviewed and the exact percentage that they will increase salaries by? If there is a date stated and it is not 1 April then outside of what they are required to do because of the mandatory introduction of the NLW for over 25's then they are not obliged to review the other pay grades until such time as the date detailed in the T&C's.

      Hi Ula,

      Thx for reply.
      Pay reviews are done annually in October. With the NLW set to rise by an average of 6% per year to 2020 and the company only giving 3 - 4% pay rises to the people on the N3 - N4 part of the grading system, soon there will be all grades on the same hourly rate. This to me seems unfair. Any advice?

        Get as many people together as possible and join a union. Strength in numbers and collective bargaining.

          Need 10% of workforce to ask for company to recognize a union. think we have the numbers but company can still refuse to recognize the union.
