  • Replaced at work

Quite simply in a meeting between myself and the two MD's of a small business I have been given notice of a week that my role as manager will be reduced along with my pay. A new manager will be inserted into my position and my duties will be changed.

I left a role id been in for ten years having been invited to new company as general manager. I have been with them for ten months on a permanent contract.

Over last three months I have had numerous business meetings that ramble for 3 more hours with MD repeating how company is not achieving targets (when I'm hitting targets) and rather than following any adgenda then launches into detail on my failings. Most often this is very subjective items and nothing that could hold any ground or lead to a disciplinary.

More recently I was given a verbal warning without any notice or offer to have representation for performing a task that is one stated on my contract. I will be appealing of course.

Since then the unscheduled meetings have been more frequent and follow same format of no adgenda but generally finding fault with any and everything possible.

I imagined that constructive dismissal was being engineerd and in the last meeting the MD mentioned 4/5 times that I might not decide to come in next Monday or might not be here in the future.

It seems that they had a plan to make me jump ship but have nothing solid to use against me to justify any real performance concern letters.

I have been told by them both that this new role is my option. No consultation
No performance review. No invitations to disciplinary. No offer to arrange a representitave.

Are they legally allowed to do this when like me they have signed a contract to employ me as a manager and at the rate of pay agreed at the beginning of my employmet?

Naturally I will move to a new business asap. However the role change is due imminently and I feel that accepting it will lessen my rights to appeal or have this arbitrary decision changed.

    Thanks in advance.

Unfortunately, as you have less than 2 years service, they can do this.
