  • Agency wage deductions

    Hi

I'm posting on behalf of a friend who doesn't have internet access...She is working full time through an agency, in receipt of minimum wage. Holiday entitlement is 'rolled up" and added to her weekly wages, and a deduction made of approximately 25.00 a week to cover admin costs (ie processing the wages!)

    My questions are:

    1) I was under the impression rolling up holidays was no longer allowed, and that any holiday entitlement should be accrued and paid during periods of annual leave - could anyone confirm that?

    2) Could the admin costs be classed as unlawful deductions if they have been imposed?

    3) Assuming the deduction brings her pay below NMW, how should she proceed?

I'm just trying to get a feel for where she stands, so do not yet have all the facts, but she has asked me to meet with her to discuss changing her employment status to self-employed as someone has advised her that would solve her problems (I'm of a mind to talk her out of that, as the same adviser also said she should register as a ltd company!)

I've looked at the ACAS website, CAB, and HMRC sites, but was hoping someone out there would have experience of this matter.

    Many thanks
    Sarah
