Hello everyone. Am looking for some advice on the above subject regarding pay. I am working on a particular project which is working under the Construction Industry Joint Council Working Rule Agreement.
There are 4 sub-contractors on the project. Each one of them adhere to this agreement where the overtime rate goes up after 39 hours. My sub-contractor does not. They pay overtime after 45 hours. It states in my contract clearly a overtime rate is enforced once 45 hours for the week has been achieved but are they breaking the law as they should be paying overtime after 39 hours?
