  • Refusing to hold sickness review

I am taking my employer to a tribunal over a disability descrimination matter. Running parallel to this has been a long term sickness absence review. I was supposed to have had a final formal meeting in Nov to look at if I would be redeployed or sacked. This hasn't happened, when I emailed my manager and asked why not she said it was unforseen circumstances. I stopped being paid months ago so I imagine their solicitor has told them to halt the sickness review.

What I want to know is can I force this issue, do I have a legal right for this final formal meeting to take place?

When you say "stopped being paid months ago" do you mean statutory sick pay (or company sick pay)?

Are you currently still ill, or fit to return to work?

So your employment was ended in November and they still carried on paying you SSP up till Dec? If they ended your employment in November then you your entitlement to SSP will have stopped too as your contract would have been terminated when they terminated your employment!

I think mechjerk was saying his company sick pay ended first and then in Dec he ran out of SSP entitlement . He didn't say anywhere that his employment had ended

I'm inclined to agree, but its vital Mechjerk comes back and clarify what he/she was meaning. As the sentence in their last post could be interpreted as either "company sick pay stopped November", or "company ended employment November". Hence my reference and questioning in regards to company employment terminated in my last post.
