Been with employer, 4 yrs exactly .First 21 months I had no contract no written statement. As previously posted at 21 months approx hlf of us were put onto 1yr fixed term contracts for 2 consec years.That ended last september and we havent got any papperwork at all. As of a few days ago I have been there continuously for 4 years. Contracts or not. Half of us inc me do not have our shifts officially on paper, despite having worked the same ones for a year easily the company still keeps some flexible and does not officially say that they are your set hours. My problem, another one is that a very recently returned maternity leaver was allowed to choose her shifts. She only has 2 and has chosen to take one of 'min'e that was 'hers' before ML.
I heard she was definitely coming back and I heard in whispers that she might take x and x but no one discussed it with me, no one said where my replacement shift would come from. Her first day back was last week and I happened to be in as holiday cover on that day. This week I have been put in again on the same shift that is actually someone else and theres a theory that he doesnt know and its a mistake he will come in and I will be sent home (gossip )
So my questions are:
1. do I have the right to a replacement shift
2.can they just put her back in where she wants
3,should they have spoken about this situation to me and given me options
4.If Ive been there longer (by 7 months) than a colleague why do I lose one and should it be replaced by one of hers
5. If I go in and he does one of us will have to go home, he has been there longer and always worked this shift so it shouid be me, but as its their mistake should they still pay me as they will have wasted my time and lost me a shift
6. Shifts that became available through a leaver over a year ago where swiftly and quietly given to a fixed termer without being offered to anyone else, is there scope for recourse there?
We all do the same titled job. No one is a specialist or has different skills.
