    Good Evening Again

    I have suffered Disability Discrimination at the hands of my employer, and my case was being reviewed by the union,for some reason they passed it on to a Solicitor where I live in Leeds for him to review and hopefully bring to an employment tribunal,

    I have had my pay reinstated at the intervention of Acas but it looks like the time may have now run out for me to bring a disability claim due to the Solicitor not reviewing the case in time,

    My question is do I have any course of redress to rectify this matter either against the solicitor in question or against my employers, I'm sorry I know this is a sensitive issus on these forums but I feel I have had wrong done to me

    You have three months minus 1 day to bring a discrimination claim to tribunal. The clock starts from date of the last act of discrimination or from the date of grievance appeal hearing! Off course if other acts of discrimination occur after that the clock then resets, such acts can be acts of victimisation i.e. by stopping your pay when your entitled to it!

    I would be putting pressure on your union about this now to speed things up a bit!

      The union person I am dealing with at the moment I think is more on the side of the employers than mine, he as had my pay re instated for me which is fantastic but the most important element of Direct and Indirect Disability Discrimination which is now causing me severe stress as it has been going on for so long seems to have taken a back seat.

      I have come across some information yesterday which shows I have suffered Disability Discrimination and that information is new to me as of yesterday so I have made a claim to Acas as per their conciliation process starting from the time I was made aware which was yesterday,

      Just one more question I need to ask and if you could give me an answer I would be most grateful.

      My company has just lost the franchise to run services from April 2016 it will be run by a new company at the end of April, I know I Tupe over but I think they will try and ill health retire me before then but if they don't can I still pursue a claim for Disability Discrimination?

      And as my last post if the solicitor who was reviewing my case did not bring a case before the 3 months minus 1 day do I have any redress from this solicitor

        If you TUPE over to the new Company you can still pursue a discrimination claim.
        You don't have a claim for redress from the solicitor.

          Can I pursue the claim even if I have been Dismissed as they put it on ill health? I will never work for anyone else due to my problems so I should ideally be retired not dismissed

            If you are dismissed 'on ill health' before the transfer date you can still pursue your current employer as long as you can show an act of discrimination within the previous 3 months.
            Depending on how they go about it, the dismissal itself could be such an act.

              Your reply is very much appreciated, it looks like I shall have to take legal advise outside of my union as I don't think they will represent me in a favourable way.

                Just an update with regards to this matter, I have now had a new Solicitor appointed to this case by my Union and all the evidence I have presented so far looks liker I have a case for Disability Discrimination Both Direct and Indirect. thank you for the information you have provided to me it is very much appreciated

                    Hi,
                    Just my 2 penny's worth. If you have legal expenses cover on house/car insurance, I would go with them. I say this as in my case couple of years ago, had I gone with my Union's appointed Solicitor, I would have had to repay their invested legal costs in pursuing my case if I had won. There was nothing to repay with houshold legal expenses. Your Union may be different, but do check.
