    OK cheers. It was done because the need for protection following a bullying spree.

    HGV course was offered and passed. A note was signed to say if you leave company before 2 years the company will take from your final pay packet outstanding money.

    Offers of two jobs were made to drive the HGV but we're then withdrawn

    New gaff came in and things went downhill as he wanted the yard lorry driven despite not being paid for doing so. Being a supervisor on a different side to the company meant the bonus target could not be met if out driving an HGV no one left to answer phones etc.

    Suffice to say was abused several times and conversation was recorded during an interview between 4 people.

    In that interview the highest manager there admitted covering up money going missing.

    Preparing to leave as internal investigation now ongoing into situation and manager states he does not wish to see my face there again. Another manager threatens to smash my face if he sees me.

    So........I am suffering depressing visited doctor who suggested I find another job and to stay sick but concerned about money being paid back.....this month's money should clear in an hour but not sure how much notice I have to give and when I can start new job.

    So you are considering resigning and want to know if you can

    a) be chased for the HGV course cost

    and

    b)claim for constructive dismissal ?

    So you started a new job and they offered to put you on a HGV course, which you did and passed etc, then the company changed hands and you weren't given work as a driver as expected.

    Now there's some bullying going on and some slightly dodgy business practices you aren't happy with and have been signed off work with depression, and on top of that your manager seems to be accusing you of being involved in some missing money ?


    How long have you been employed there ?

    How long ago was the HGV course completed?

    Did you sort out your other issue about the non payment of invoices / VAT etc ? is this related at all ?
