  • Statutory redundancy

I'm sure these are questions that have been covered before, but couldn't find them sorry:

1/ For statutory redundancy pay, the law says that, to be eligible, you need to have worked for an employer for two years. I will have been ten days short of that mark when I leave my present company (who have, cheerfully, decided to make my post redundant and told me just before Xmas) - am I really entitled to no statutory redundancy pay at all in this limit case?

2/ My post and my boss's post are both to be made redundant, and a new position to be created between them on the pay scale. I was not consulted about this at all until yesterday, when there was a brief meeting during which I was told that my post would be made redundant, and that I was 'welcome to apply' for the new post.
Is there any kind of consultancy process that my employer should have followed in such a case?

      Re: Statutory redundancy

      1. You need a minimum of 2 complete years service to be entitled to a redundancy payment. If you are only 1 day short you don't qualify.
You'll be entitled to be paid for any accrued untaken holiday entitlement.
You mention 'when I leave' which suggests that they have already given you notice. Is this correct?

      2. In he circumstances of just 1 role being made redundant, the brief meeting is sufficient consultation.
Have you applied for the new role?

        Re: Statutory redundancy

Thanks Marie for the useful if bleak information (and thanks Kati for the tagging). You're correct, they gave me notice on Tuesday that my last day would be January 31st.

I haven't applied for the new role, and have no intention of doing so in the cicrumstances.

          Re: Statutory redundancy

How many employees does the company have and how many do the same or similar role as you?

How much notice has your employer given you? Because if the notice period takes you to 2 years service then that entitles you to redundancy pay. Also check your contract as the employer may have there own redundancy terms, meaning instead of entitlement to statutory redundancy pay, the employer may pay contractual redundancy to you, i.e. eligibility for contractual redundancy may be 1 years service instead of two!
