  • Employment law help needed..contracts

    Hi guys

I need some advice regarding the above.

I am on a fixed term contract (ends 31st March 2016) - renewed yearly. I have received a letter (with a weeks notice) about organisational changes and the implications on my role. I have been saying for several months that the role I am doing (or attempting to do!!) needs another body to work 1/2 days a week alongside me.

Basically, I have been diagnosed with depression by my doctor a couple of months ago and I believe this is due to the pressure at work. The increase in workload has continued and I have mostly been ignored by my employers when I have pointed out the pressure this is causing to me.

I feel they have ignored my concerns and used me regardless, to clear the present influx of workload and now, conveniently, they have produced this letter about a consultation.

I believe they are now going to reduce me to 2 days for part of my role and bring someone else in for the other half (to work around 3.5/4 days).

This has really set me back and I don't feel able to attend this meeting (I have not confirmed my attendance as requested in the letter).

I need to know if they can still hold this meeting in my absence and continue with the changes to my contract.

My contract states the usual things such as hours of work, sickness pay, holidays etc.

It does say that they can make amendments in line with employment law and the organisations policies and procedures but only in agreement with the relevant trade union. I am not in a union.

With regards to flexible working - the policy is for if the employee wants to apply for flexible working.

    Thanks in advance

Hey FoxyFluegel - You posted in the VIP General Discussion section rather than the employment section of the forum - hence why you probably not had any response to your thread as yet!

I have asked the Site Team to move the thread to the employment section for you.

Given its been a few weeks now since your post, can you fill us in on the latest develops so we can advise you with upto date advice based on the current standing of your situation.

Regarding Changes of employment contract - They need your prior consent to vary the terms of your contract! But i suspect their is a bigger issue here. So i also need to see a copy of the letter you mentioned in your first post, so if you can post it up minus personal and company details that would be great too. Though your contract terminates on in March 2016 - So you haven't much to gain by refusing to the changes, but then how long have you been employed for and how many fixed term contracts have you had (or extensions to the contract) since you first started working there?
