  • does this count as constructive dismissal for me

my employer who I have made other posts about know have got my wages wrong twice
and this time I have no choice probably but to resign and apply first to acas for constructive dismissal
and this what is my manager says which is complete fabrication:
Are you missing my emails or deliberately attempting to ignore what I have been telling you? I had given you the benefit of the doubt when working as XXXX, but I can now clearly see how the issues at this site had arisen.

I had shifts at XXXX, but you have refuse to work at this location, I also had work lined up at XXXXX, but your standard of work and attire have lead to a request from the client for you to not be placed as cover at this site, along with a similar storey from the XXXX, and previous visits to XXXXX have not had glowing reports.

Whichever shifts you pick up this month will be what you are paid for, please take this email the way it is intended as (as advice) you need to start improving you standards, if you drop the ball at XXXX, I will have now where else for you to work other than London, and I'll have to seriously look at you suitability as a security officer.

I'm in the process of resolving your pay query from last month; as I have advised; please refrain from emailing multiple times per day and asking me the same question.

    Kind Regards

    my message

    Hi
So why haven't i been paid yet it is over a week late Know you haven't haven't explained why this happened and i can not afford for this to happen Again. I only wanted to know how to get into XXXX sorry to make sure i could check my shifts As i haven't been given any information on how to log into it.
XXXXX has been on holiday. I was expecting 130*£7.07 I have made myself available for all the shifts othered.
    Regards Lee Sapsford

My view which isn't what you will want to hear, is that your manager appears to be supportive in finding you alternative work.

I sense from his email you might not be helping yourself and your email response wasn't useful and only served to frustrate him more, when he has stated he is resolving your issue. Whilst frustrating fur you, you need to maintain professionalism at all times.

    This is not constructive dismissal.

you don't realise he wants me to do 50+miles there and back on a job which is just over minimum wage and also having to pay parking as well on top with out the extra running costs this would do to my old car which is half on its way out and can't afford to fix. When I used to do only 40 miles there and back and for the more or less the same money so I don't really think he is being helpful.perhaps I should have added that first.

I agree - this doesn't seem like a case of constructive dismissal. For constructive dismissal to apply there has to be a fundamental breach of the employment contract, which doesn't seem to be the case here.
