  • Breach of data protection act

I work in a restaurant and during my last shift I couldn't walk I was in severe pain. I was made to work through and later diagnosed with tendonitis in my leg and signed off work. My supervisor sent out an email to everyone in my department stating that due to my injury I would be off work for a week so everyone's shifts had been changed so can they check the rota. I'm pretty sure that's a breach of the data protection act..? And now they are refusing to pay SSP saying I haven't earnt enough money with them, I thought the only government requirement was to work for 4 weeks min before you were eligible?

Do yo earn more that £112.00 a week before tax?

You employer claims back your SSP from the Government so saying you have not paid enough in is a red herring by your employer and a breach of a statutory right

Thanks guys, yeah I checked all that and have commented on it to my employer but have had no response. Would it make a difference if because I'm paid monthly and the only pay check I had received before being signed off only covered 11 days work even though I had worked just over 4 weeks before being signed off?
