I have been diagnosed with high blood pressure which has been put down to stress at work. My doctor suggested I ask my employer for an occupational health assessment. I asked for one but was instead given a workplace stress assessment. I feel my employer is avoiding the occupational health assessment because they would have to make reasonable changes if told to do so. Does my employer have to give me an occupational health assessment or can they keep avoiding it? Are they breaking any regulations by not giving me an occupational health assessment after I asked for one on the instructions of my doctor? Thanks

Re: Occupational health assessment
Bleeding typical
You have been asked to request an Occupational health assessment by a General Practioner who is Qualified as he is concerned with your health and they give you a clip board to play with?? Now i am angry
You need to put in a letter to your emloyer that on advice from your GP a referral to occupational health is immediately required. The work place stress assessment given to me to complete is unacceptable as my GP has taken precedent on the matter
I will now give you the legislation to quote:
Regulation 7 Health and Safety at work Act 1974 makes it an oblgation for all employees while at work to take care of their health and safety and other who may be affected by his actions
Regulation 3 Health and Safety at Work Act 1974 makes it an obligation of every employere to ensure the welfare of their employees and those not in his employment
Now Regulation 3 Management of Health and Safety at Work Regulations 1999 (This is the killer blow)
Risk assessment
3.—(1) Every employer shall make a suitable and sufficient assessment of—
(a)the risks to the health and safety of his employees to which they are exposed whilst they are at work; and
(b)the risks to the health and safety of persons not in his employment arising out of or in connection with the conduct by him of his undertaking,

Re: Occupational health assessment
Hi judgemental24
Please can you clarify the legislation and Sections/Regulations you are quoting? AFAIK the Health and Safety at Work Act 1974 (like all Acts) is made up of Sections not Regulations.
