    Hello all, this is my first post. ive been in two minds about asking for help for a long while now. But I dont know what to do as what is happening to me is a bit hard to talk to management about.

    I work for a security firm. I started as a retail guard then worked my way up to supervisor as a mobile response driver then was demoted to a security guard again in June. From my time as a retail guard I had no problems, it all seemed to happen when I was made supervisor. One of the office staff (ill call dave) dave kept tracking me when I was driving and only me. He used to track me from his own house and text me to ask me why I was at a certin area... would get me to do the dutied he should have done during his shift like delivering rotas, uniform, pick up keys ect.. would constantly contact me on my days off to give off about keys missing or why something (that he should have done) had not been done.

    Once I went to have a cup of coffee with a guard at one of our sites (as all my work had been done) i was questioned as to why i was there and that all drivers are to stay away from that site. On my next shift i called the other drivers and asked about this site we have to stay away from, as I thought they were not told to stay away so i went down again and had another cup of coffe. The next morning when i finished my shift and handed over to dave he again questioned my being at that site i said noone else was told and he said i was told and the next time i go down there i will be removed from the supervisors position I stood up to him in the office and told him to go stuff himself and I walked out of work. I emailed the owner of the company about all that was happening and he refered my email to the financial director... he called me wanting to know what was happening I explained that he was belittling and making threats about having me removed from my position for visiting a site. I went on to say I need a few days off because im not in the right frame of mind to do my job. He convinced me to work but I was still protesting as I was feeling really depressed about the whole thing. During my next shift I missed an alarm call and was then removed from the supervisors position.
    Dave (being the one who does the rotas) was giving me 2-3 shifts a week (very hard to live on when you have 3 kids) and they included being retail shifts (retail was something dave, upper management and myself agreed never to put me into it again as it is very straining and I done it for two years) after refusing retail he said it was a once of and would not rota me in again. But when the next rota came out there was more retail, this pushed me over the edge and I refused flat out. For the next few weeks I was getting barely any hours and after sending him an email about my hours and that any time anyone refused retail he would give them a perminant 4 day on 4 day off 12 hour shift and why I was exempt from this. He never replied but gave me alot more hours.

    One of the most embarrassing moments is when I started the driving dave was a friend on facebook. He decided to get a picture of me in my wifes nighty (have no shame :-p) and put a copy of it on the companys notice board. I took It off and the next day it appeard again on the board he said he thought it was funny. But I didnt. He didn't care. It took 2-3 months before the security manager took it down.

    Another incident with dave is when I had a run in with a guard. I was verbably abused and threatened. I wrote a report and handed it to dave. But nothing was done about it even tho I had witnsesses to the abuse and he said its not his problem.

    On day he asked me to cover a site to which I accepted when I got there I realised there was no runnung water clean toilets and nowere to site. I contacted the control room about their being no water and it was refered to the driver. The driver was to bring bottled water up to me but never turned up.

    there are tones more incidents with dave. But these are the ones that have affected me the most. It has caused me to go onto antidepressants and be very consious at work especcially when he texts me and asks me about something like he is trying to trip me up and drop me in it.

    I dont know what to do if there is even anything I can do. I feel I cant contact upper management as nothing seems to be getting done.

    sorry if any of this doesn't make sense (have a hard time wording things properly and im really sorry for it being too long. Didnt expext to write a book. But thank you for taking the time to read this.

      When you were demoted, was any disciplinary process carried out?

      Daves actions towards you amount to bullying and harassment so you need to put in a formal grievance letter against Dave and include in it a canonical list of events with rough dates and brief descriptions, as well as how he had you doing his duties for him too, and point out that they have a duty of care to protect employees from being bullied and harassed at work. Don't send it in yet though as may have more for you to add to the letter.

      Regarding the tracking, can you tell me what the company policy is in regards to tracking employees, and who can track them and if Dave was allowed to track you from his home or home/personal computer/laptop as well as company computer/laptop or even phone?

        There was no disciplinary action taken as i would have been sacked due to potentially loosing them the contract., and they "didn't want to go down that road" I believe that is because I am currently the owner of the company's tenant and paying him rent. i only believe this because missing an alarm call is Gross misconduct and an immediate dismissal and that never happened.

        the tracking, I was not told of any policy other than it was brought in to cut down on insurance for the vehicles and to please the Auditors of the company. Dave was "told off" for using the tracker at home by an old security manager (who has since left the company) the password was changed and the tracking stopped until the security manager left and Dave got the password from another member of staff. he was then told he was only allowed to use the tracker to get times of arrival and departure for invoicing purposes, but i was still getting phone calls at random times of the night asking why I was at a certain location, this was whilst he was at home as he finishes his shift at 17:00 and my shift started at that time.

        I shall get onto writing up the letter as I've kept a word document from when I started with the company that has dates and times of incidents including texts and email screenshots between me and Dave also the company.

            Ok you need to include the tracking issue and daves abuse of the tracking system, if this resulted in him calling you when you were not on work time and on your own time, then thats criminal harassment and likewise, if you used vehicle for personal use in your own time then thats an invasion of your privacy and also amounts to a breach of mutual trust and confidence.

            And yes [MENTION=57704]Trev1234[/MENTION] having the screen shots etc etc is gold lol.

            As for the demotion, we shall leave that out for now, but it will prove useful as an ace card up our sleeves if things turn nasty when you issue the grievance, as even if you had committed gross misconduct you do have strong and reasonable mitigating circumstances i.e. stress caused by daves bullying and harassment, which had a significant effect on your state of mind and ability to perform your duties. So we can easily link your act of gross misconduct as being a direct result of companies failure to protect you from being bullied and harassed at work. So any dismissal would have been unfair, and fact the demoted you means they did carry out formal disciplinary punishment and therefore their excuse for not carrying out a disciplinary procedure is bullshit, because they could have just as easily demoted you like they did instead of dismissing you even if they had carried out a disciplinary procedure. So an ET will rule against them on that too!!

              Teaboy sorry for this late reply i have only seen this =S

              I have been writing up a grievance letter (Wich is not short ) and have been in talks with an outside union rep and will hopefully be pushing forward with it soon.

              but have been invited to a fact finding meeting (unrelated to above)... here is the thread.
