  • Disciplinary policy not followed. Where does that leave me?

    I'm still waiting for my appeal date. Been 4 weeks now. Acas have said 2 weeks would be fair to wait and 4 weeks is not following their fair policy. I was thinking as the company policy states on suspension I will be given the suspension policy and suspended in writing. There was no letter or policy given to me until I entered the interview the following day. I had no time to study the policy and was very unprepared.

    Secondly and much more seriously their disciplinary policy states any medical factors MUST be investigated and either my gp or occupational health must be consulted. This wasn't followed either and as soon as I mentioned my health and showed them my folder of medical notes and a letter from my specialist they said it was irrelevant. They didn't even look in the folder.

    Clearly they haven't followed a fair process and are in breach of contract by not following their own policy. Does this leave the whole disciplinary void? Or is it just unfair dismissal?

    Its unfair dismissal, and also a breach of contract, breach of contractual mutual trust and confidence, and possibly a breach of contractual duty of care (regarding medical evidence being disregarded)!
