    Your boss decides that you have broken a procedure. They then decide you need investigating. Has your boss now prejudged you by making those decisions? Your boss gets someone else to do the investigation, and there are other people who could do the disciplinary but, would it be a fair hearing if your boss does the disciplinary?

    I don't think it could be a fair hearing because your boss had already decided you HAD broken procedure and that you NEEDED investigating. How can your boss then do an impartial disciplinary. But that's just my opinion and I cant find any case law on this.

      it is acceptable if its a SME where they have limited staff - For example a small corner shop where only 2 staff Manger/Owner and Shop assistant, in which case the manager/owner would carry out the investigation, disciplinary, appeal etc, though they would have to show they had grounds for reasonable belief!
