  • Alarm activation times being used as evidence

    Good Afternoon All,
The entire team and I have been called to a disciplinary meeting using the time logs from our alarm activation records as the key evidence.
I have photographic proof that the time is displaying incorrectly on the alarm system, and am aware that the alarm system has also been wrong by a wider margin in the recent past.
Can I discredit the evidence given that it is proven incorrect??

During the last week I asked for all the evidence to fully prepare us against the case, all I was provided with was the alarm activation log.
From my research I read somewhere that an alarm company must provide you with an Alarm Calibration Certificate to ensure the accuracy of the times, is this correct?

Also there has been no communication or documentation to state that the alarm system would be used in this manner, can an employer use this as a clocking system without the knowledge of the employees?

As an additional point i have been in contact with citizens advice and ACAS and neither can shed any light on the situation - the meeting is tomorrow!

    Thank You!

    Hi welcome to LB,
The situation you have laid out is far to vague I would say for anyone to give
    meaningful advice.
What type of alarm in what type of business who is responsible specifically
    for setting/operating the alarm system?

      Hi Thanks for the welcome,
The alarm is an adt security alarm system which is deactivated by the first team member in to the building and deactivated by the last team member leaving.

there is one code to activate and deactivate the alarm for all colleagues, so everybody uses the same code, and its whoever arrives first or leaves last that is responsible. the business is a retail store.

I currently (launched prior to being called for this disciplinary meeting) have a grievance in with the investigator (senior manager) within the company for harassment and bullying, so am obviously trying to ensure that any evidence they do have is legally accurate and hasn't been used just as an excuse to stop the grievance process by removing me from the company. As i have only been there for 14 months i know i am not protected for unfair or unlawful dismissal so trying to save what I have left.

      Thanks

Hi, You should be able to submit any evidence you have " Legally" obtained if accusations are made you must be able to answer/refute them.

its not that uncommon for devices like alarms and CCTVs to sometime not update for BST ect.

If the alarms internal battery has died, it can reset to the manufacture date,

In both circumstances, the real time can be easily calculated,

It would be very unusual to have different time variations ( f you get my meaning ). over different days, internal timing mechanisms of alarms and cctvs dont generally drift, they will iether fault by a known amount, or read correctly. If you can describe the timings clearer, i can be more specific.

The logs may not be based on the time shown on the alarm system in the shop itself, the log will be from the alarm company and likely based on the time on their server!

What exactly have you all been accused of is more important than arguing over alarm times! So what exactly have you all been accused off. And not only that, why on earth does everyone in the shop have a key and a code for the alarm system. Only Manager, assistant manager and/or shift leader should have a key!
