  • Opt out of Sunday work. Advice?

    Right, before I make any kind of request I want some advice first as I don't want to ruin my relationship with the company or my colleagues.

    I currently work in a mobile phone shop in a shopping centre, I have been here over year and currently work everyday apart from Tuesday & Saturday. I've read about the right to opt out of Sunday working but what does this actually entail? I'm well aware I would have to work an extra day in the week.

    In what right can my employer refuse it?

    The reason I want to opt out is because as it stands, it's not fair the way the rota works it's only me and one other person who works everyday weekend without fail.

    You have the right to opt out of Sunday working under s40 of the Employment Rights Act 1996 http://www.legislation.gov.uk/ukpga/...of-sunday-work

    As far as I know, your employer is not obliged to give you an additional day during the week in these circumstances.

      I am contracted to 45 hours so would this mean the company could just reduce my contract if they wanted?

      Would I put my request to my manager or to HR? I'm guessing to my manager?

        I would say to your manager.

        The notice takes effect 3 months after the date it is given.

        I am not certain about any reduction in your hours, it depends as far as I can see whether you are actually contracted to work on a Sunday.
